From what they told me, often times they are brought in for other ambiguous charges (such as inappropriate public behavior), and kept without explanation. The woman, "Rosa" I spoke to was arrested under such circumstances, and kept for several years without charge in the 1980s. That is not true, I had lesbian and gay co-workers during the late 80's, and I never saw any discriminatory action against them, however gay men that dressed like women, were arrested, as well as male prostitutes, especially around cabarets, night clubs and hotels. I never learned of gay or lesbian arrested just because they were. &lt;/p&gt;

The US Constitution clearly states that immigration is an issue that only the federal government can write legislation for in Article I, Sections 8 and 9. Section 8 says Congress has the power "to establish an uniform rule of naturalization." Section 9 says Congress has the authority to handle the "migration or importation" of people into the country. States only have the authority to carry out the federal immigration laws. States' rights people need to reread the Constitution and check their facts.&lt;/p&gt;

&lt;p&gt;If the Supreme Court sides with Arizona, the Democrats in Congress can use this as a rallying cry to create another federal law (or perhaps an Amendment?) that outlaws SB 1070 and similar state laws dealing with immigration.
